Welcome to Tropical Haven Property Solutions. By accessing our website, requesting a tailored proposal, scheduling services, or entering into any agreement with us, you (“client,” “customer,” “vendor,” “contractor,” “subcontractor,” or “property owner”) agree to the following Terms & Conditions. These Terms apply to all residential and commercial landscaping services, vendor interactions, contractor engagements, subcontractor engagements, any third party affiliate, and any communications with Tropical Haven.
1. Scope of Services
Tropical Haven Property Solutions provides professional landscaping, lawncare, outdoor enhancement, and property improvement services for residential and commercial properties. Services may include, but are not limited to:
• Landscape transformations, outdoor renovations, and property rejuvenation services
• Landscape maintenance and premium lawn care services
• Grading, excavation, drainage improvements, and property preparation services
• Sod installation and landscape material installation including mulch, rip-rap, shell, topsoil, sand, decorative rock, gravel, stone, and Limestone 89
• Palm tree pruning, tree trimming, shrub trimming, hedge trimming, and landscape maintenance services
• Seasonal property services, storm preparation, hurricane-related cleanup, debris removal, and storm recovery services
Services not specifically listed within an approved estimate, proposal, invoice, or written agreement shall be considered outside the approved project scope unless otherwise authorized in writing by Tropical Haven Property Solutions.
Tropical Haven Property Solutions does not provide irrigation installation, irrigation repair services, electrical work, landscape lighting installation or repair, plumbing services, structural construction, engineering services, or other licensed trade services unless explicitly stated otherwise in writing.
Any requests outside the scope of services offered by Tropical Haven Property Solutions may be declined or referred to independent third-party professionals when reasonably appropriate. Any such referrals are provided solely as a courtesy and shall not constitute responsibility, endorsement, warranty, supervision, or liability for the work, services, conduct, licensing, scheduling, pricing, or performance of any third-party contractor or company.
As a courtesy, Tropical Haven Property Solutions may visually inspect or briefly test irrigation functionality onsite to identify observable concerns related to watering schedules, irrigation coverage, or visible system performance. However, Tropical Haven Property Solutions is not a licensed irrigation contractor and assumes no responsibility or liability for irrigation system design, functionality, underground components, concealed lines, leaks, valve failures, timer malfunctions, wiring issues, improper installation, aging systems, or existing irrigation-related defects.
Client acknowledges that underground irrigation systems and related components may not always be visible or accurately marked. Tropical Haven Property Solutions shall not be held liable for accidental damage to undisclosed, concealed, improperly marked, improperly installed, deteriorated, aging, abandoned, or pre-existing irrigation systems, underground utilities, drainage components, or related underground structures encountered during landscaping, grading, excavation, sod installation, drainage work, or related services.
2. Estimates, Proposals & Pricing
All estimates, proposals, pricing, and project recommendations provided by Tropical Haven Property Solutions are based upon conditions observed, information provided, and site conditions visible or reasonably identifiable at the time of evaluation.
Pricing may be subject to adjustment if unforeseen conditions, concealed site issues, material cost increases, restricted access conditions, changes in project scope, additional labor requirements, client-requested modifications, or other circumstances arise before or during the performance of services.
Unless otherwise stated in writing, all estimates and proposals are valid for fifteen (15) calendar days from the date issued. Pricing, material availability, scheduling availability, and project timelines may change after the expiration period.
No services, scheduling, material procurement, or project preparation shall begin without written approval or authorization from the client. Approval may include signed agreements, digital approvals, emailed confirmations, text message confirmations, invoice approvals, or payment submissions authorizing Tropical Haven Property Solutions to proceed with services.
3. Deposit, Payment & Scheduling Requirements
To reserve scheduling availability and secure a project start date, a non-transferable deposit equal to fifty percent (50%) of the approved project total may be required at the time of booking, unless otherwise agreed to in writing by Tropical Haven Property Solutions.
The required deposit is intended to secure scheduling availability, allocate labor resources, reserve equipment, coordinate logistics, and prepare or procure project-related materials necessary for the scheduled services.
Projects, services, or scheduling dates shall not be considered confirmed or guaranteed until the required deposit has been successfully received and approved by Tropical Haven Property Solutions.
Deposits become non-refundable within seventy-two (72) hours of the scheduled project or service start date due to scheduling commitments, labor allocation, operational preparation, and potential material procurement associated with the reserved project timeframe.
Tropical Haven Property Solutions reserves the right to delay, reschedule, or cancel scheduling availability if required deposits or approved payment arrangements are not received within the requested timeframe.
4. Automatic Payments
Clients must maintain a valid payment method on file. The remaining project balance will be automatically processed on the day service begins. If payment fails, Tropical Haven Property Solutions reserves the right to delay, reschedule, or suspend services until payment is successfully secured.
For client security and privacy, Tropical Haven Property Solutions does not have access to full payment account details. Payment information is securely processed and stored through third-party payment processing platforms, and only limited identifying information may be visible to us, such as the last four digits of the payment method provided. Any personal information voluntarily submitted by the client, including name, phone number, email address, property address, referral source, project details, budget information, or scheduling preferences, is used solely for business operations, communication, scheduling, and service-related purposes.
5. Cancellations & Rescheduling
Because scheduling a project requires reserving dedicated labor, equipment, materials, scheduling availability, and operational resources specifically for your project, the following cancellation and rescheduling policies apply:
• Deposits become non-refundable within seventy-two (72) hours of the scheduled project start date.
• Cancellations made within seventy-two (72) hours of the scheduled start date will result in forfeiture of the deposit.
• Rescheduling requests are subject to calendar and operational availability.
• Weather delays, hazardous conditions, or unforeseen environmental conditions do not constitute a breach of contract and will not incur penalties.
6. Client Responsibilities & Property Conditions
Clients are responsible for ensuring that the property is reasonably accessible, safe, and properly prepared for scheduled services. By approving services, the client agrees to the following responsibilities:
• Provide safe, clear, and unobstructed access to all designated work areas throughout the duration of the project or scheduled service
• Remove or secure vehicles, outdoor furniture, decorations, equipment, pets, personal belongings, and other obstacles from active work zones prior to service arrival
• Clearly disclose and identify any known underground utilities, irrigation systems, drainage systems, septic systems, invisible fencing, low-voltage wiring, concealed lines, underground structures, or hazardous conditions located on the property
• Notify Tropical Haven Property Solutions of any property conditions that may affect safety, service performance, equipment access, drainage, grading, excavation, or installation work
• Properly maintain installed plants, trees, sod, irrigation schedules, and landscape materials following installation unless ongoing maintenance services have been separately contracted
Tropical Haven Property Solutions shall not be held responsible for damages related to undisclosed, improperly marked, concealed, abandoned, deteriorated, or inaccurately identified underground utilities, irrigation components, drainage systems, wiring, obstructions, or property conditions not reasonably visible prior to service performance.
7. Property Access Authorization & Project Documentation
By requesting, approving, scheduling, or permitting services to be performed, the client authorizes Tropical Haven Property Solutions, its employees, subcontractors, and authorized representatives to access the property as reasonably necessary for project evaluations, site visits, material deliveries, scheduled services, project completion, inspections, and related operational activities.
Client acknowledges and agrees that Tropical Haven Property Solutions may photograph, video record, or otherwise document project conditions before, during, and after services are performed for purposes including, but not limited to:
• Project documentation
• Quality control and service verification
• Internal recordkeeping
• Insurance or liability documentation
• Marketing, advertising, website, portfolio, and social media use
Tropical Haven Property Solutions will make reasonable efforts to avoid capturing personally sensitive information. No personal financial information, private documents, or personally identifying client information will be intentionally disclosed publicly without client consent. Clients who do not wish for project images to be used for marketing or promotional purposes must submit a written opt-out request prior to the commencement of services.
8. Weather, Site Conditions & Environmental Delays
Tropical Haven Property Solutions reserves the right to delay, reschedule, modify, or temporarily suspend services due to weather conditions, environmental factors, unsafe working conditions, material shortages, supplier delays, equipment failure, restricted site access, or other conditions beyond our reasonable control.
Such conditions may include, but are not limited to:
• Rain or severe weather conditions
• Hurricanes, tropical storms, or storm-related conditions
• Excessive heat or hazardous temperatures
• Flooding, saturated ground conditions, or unsafe terrain
• Hazardous working environments or safety concerns
• Material or supply availability delays
• Equipment or transportation-related delays
Any scheduling adjustments resulting from these conditions shall not constitute a breach of contract, cancellation of services, or grounds for penalties, damages, refunds, or compensation claims against Tropical Haven Property Solutions.
9. Material Selection, Plant Availability & Substitutions
Plant, tree, sod, mulch, stone, shell, and other landscape material availability may vary due to seasonal availability, supplier inventory, weather conditions, transportation delays, market fluctuations, or other factors beyond the control of Tropical Haven Property Solutions.
While Tropical Haven Property Solutions will make reasonable efforts to source requested plants, materials, colors, sizes, or product selections specified by the client, availability cannot be guaranteed. In the event a requested material becomes unavailable, discontinued, delayed, damaged, or unsuitable for installation conditions, Tropical Haven Property Solutions reserves the right to substitute comparable materials, products, or plant varieties of equal or greater quality, value, functionality, or aesthetic similarity when reasonably necessary.
Any significant material substitutions that substantially alter the appearance, functionality, or project cost may be communicated to the client prior to installation when reasonably possible.
10. Plant, Sod & Material Warranty Disclaimer
Due to environmental conditions and factors beyond the control of Tropical Haven Property Solutions, all plants, trees, shrubs, sod, mulch, and landscape materials are installed without guarantee or warranty unless otherwise provided in writing.
Tropical Haven Property Solutions shall not be held responsible for plant loss, declining plant health, sod failure, discoloration, pest infestations, fungal conditions, disease, root shock, drainage-related issues, irrigation failures, weather-related damage, acts of nature, flooding, drought conditions, excessive rainfall, freeze damage, salt exposure, animal damage, or improper maintenance following installation.
Proper watering, irrigation monitoring, drainage conditions, fertilization, pest prevention, and ongoing landscape maintenance remain the responsibility of the property owner unless the client is actively enrolled in an ongoing maintenance program specifically covering such services.
Tropical Haven Property Solutions does not guarantee plant survival or sod establishment due to the unpredictable nature of environmental conditions, irrigation performance, soil conditions, property drainage, weather patterns, and maintenance practices outside of our control.
Landscape care recommendations or maintenance guidance may be provided as a courtesy upon request.
11. Project Photography, Media & Marketing Authorization
Tropical Haven Property Solutions may photograph, video record, or otherwise document projects before, during, and after services are performed for purposes including, but not limited to:
• Project documentation and recordkeeping
• Quality assurance and service verification
• Internal training or operational review
• Insurance or liability documentation
• Marketing, advertising, portfolio, website, social media, promotional, or educational purposes
Project media may include landscape areas, outdoor features, completed work, equipment, materials, and general property improvements related to the services performed.
Tropical Haven Property Solutions will make reasonable efforts to avoid displaying personally sensitive information or identifiable personal details unrelated to the project itself. No confidential client information will be intentionally disclosed publicly.
Clients who do not consent to the use of project-related photographs or videos for marketing or promotional purposes must submit a written opt-out request prior to the commencement or completion of services.
12. Vendor, Subcontractor & Third-Party Contractor Requirements
All vendors, subcontractors, independent contractors, suppliers, and third-party affiliates working with or on behalf of Tropical Haven Property Solutions are expected to maintain professional standards consistent with the company’s operational, safety, and service expectations.
All applicable parties must:
• Maintain all required licensing, certifications, and insurance coverage applicable to their trade or services, when required by law or project scope
• Comply with all applicable local, state, and federal laws, regulations, and safety requirements
• Conduct themselves in a professional, respectful, and ethical manner while representing or working alongside Tropical Haven Property Solutions
• Maintain confidentiality regarding client information, project details, pricing, operations, and proprietary business information
• Follow all onsite safety procedures and operational directives
• Avoid conduct that may damage property, compromise safety, interfere with operations, or negatively impact client relationships or company reputation
Tropical Haven Property Solutions reserves the right to immediately suspend, remove, or terminate any vendor, subcontractor, or third-party relationship for non-compliance, unsafe conduct, unprofessional behavior, breach of confidentiality, failure to meet operational standards, or violation of these Terms & Conditions.
13. Limitation of Liability
Tropical Haven Property Solutions shall not be held liable for any damages, losses, delays, or additional costs arising from conditions or circumstances beyond our reasonable control, including but not limited to:
• Pre-existing property damage or defective conditions
• Hidden, undisclosed, or improperly marked underground utilities, irrigation systems, drainage systems, wiring, pipes, septic systems, or concealed structures
• Soil instability, underground obstructions, erosion, or unforeseen site conditions
• Client negligence, misuse, lack of maintenance, or failure to follow recommended care instructions
• Damage caused by weather conditions, hurricanes, storms, flooding, drought, excessive rainfall, pests, insects, disease, wildlife, animals, or other natural forces
• Delays caused by weather conditions, supplier shortages, material availability issues, transportation disruptions, labor shortages, equipment failure, or restricted property access
• Damage resulting from third-party contractors, vendors, utility companies, or services outside the control of Tropical Haven Property Solutions
Client acknowledges that landscaping, excavation, grading, drainage, plant installation, and outdoor improvement services involve inherent risks associated with environmental conditions, underground conditions, and natural elements.
To the fullest extent permitted by law, Tropical Haven Property Solutions’ total liability for any claim arising out of services performed shall be strictly limited to the amount paid by the client for the specific service directly giving rise to the claim. Under no circumstances shall Tropical Haven Property Solutions be liable for indirect, incidental, consequential, special, punitive, or speculative damages, including but not limited to loss of property value, loss of use, business interruption, or alleged future damages.
14. Non-Payment & Late Fees
All invoices are due according to the payment terms stated within the approved estimate, proposal, invoice, contract, or service agreement. Any balance not paid in full within ten (10) calendar days of the invoice date or payment due date shall incur a late fee equal to ten percent (10%) of the outstanding balance or one hundred dollars ($100) per day, whichever amount is greater. Late fees shall accrue daily until the outstanding balance, including all applicable fees and charges, is paid in full.
Partial payments shall not waive the accrual of late fees on any remaining outstanding balance. Acceptance of partial payment does not constitute a waiver of Tropical Haven Property Solutions’ right to pursue the remaining balance owed, accrued late fees, collection costs, legal remedies, or damages permitted by law.
Tropical Haven Property Solutions reserves the right to immediately suspend, reschedule, refuse, or terminate ongoing or future services for any client, contractor, third-party affiliate, commercial account, or property owner with a past due balance. Any service suspension resulting from non-payment shall not constitute a breach of contract by Tropical Haven Property Solutions.
Client agrees to remain responsible for all costs associated with collection efforts, including but not limited to collection agency fees, administrative costs, court costs, filing fees, attorney’s fees, interest, and any other expenses incurred in recovering unpaid balances.
Returned payments, declined transactions, chargebacks, or insufficient funds may result in additional administrative fees and immediate suspension of services until the account is brought current.
Failure by Tropical Haven Property Solutions to immediately enforce any late fee, penalty, or contractual right shall not constitute a waiver of its right to enforce such provisions at any time.
Any disputes arising under these Terms & Conditions shall be governed by the laws of the State of Florida.
15.Right to Refuse, Suspend, or Terminate Services
Tropical Haven Property Solutions reserves the right to refuse, suspend, reschedule, or terminate services at any time when conditions interfere with safe operations, contractual compliance, professional working conditions, or the ability to properly perform services.
Services may be refused, delayed, suspended, or terminated for reasons including, but not limited to:
• Unsafe, hazardous, threatening, or dangerous working conditions
• Failure to provide timely payment or maintain a valid payment method on file
• Past due balances, declined payments, chargebacks, or payment disputes
• Repeated denial of property access or inability to access designated work areas
• Unreasonable scope changes, excessive modifications, or requests outside the approved project scope
• Disrespectful, abusive, threatening, harassing, discriminatory, or unprofessional behavior toward Tropical Haven Property Solutions staff, representatives, subcontractors, or affiliates
• Client interference that prevents efficient or proper completion of services
• Conditions that may expose Tropical Haven Property Solutions to unreasonable liability or operational risk
Any suspension, delay, or termination of services resulting from client non-compliance, non-payment, unsafe conditions, or violation of these Terms & Conditions shall not constitute a breach of contract by Tropical Haven Property Solutions.
Any unused balances, deposits, or remaining funds may be applied toward outstanding invoices, accrued late fees, material costs, administrative expenses, cancellation fees, damages, or other amounts owed under the agreement.
16.Acceptance of Terms & Conditions
By accessing or using the Tropical Haven Property Solutions website, requesting information, submitting a service inquiry, approving an estimate or proposal, signing a contract or service agreement, scheduling services, providing payment information, paying a deposit, or otherwise engaging Tropical Haven Property Solutions for services, the client acknowledges that they have read, understood, and agreed to be legally bound by these Terms & Conditions.
Client further acknowledges and agrees that electronic approvals, digital signatures, emailed approvals, text message confirmations, payment submissions, or authorization to begin work may be treated as valid acceptance of these Terms & Conditions to the fullest extent permitted by law.
